Q: What is the policy about the two water fountains in town (by Central Park and St. James). Are we allowed to play in them?
A: Thank you for your question. On a hot day, the waters in our local parks can be quite tempting. However, in short it is a petty misdemeanor to swim, bathe or wade in any waters located in our local parks.
Section 10.18, Subd. 5. Recreational Activities. A. Bathing and Swimming.
1. Designated Areas — It is a petty misdemeanor for any person in a park to:
(a) Swim, bathe, or wade in any waters or waterways in or adjacent to any park, or adjacent to any riverbank protected by riprap, specifically the shoreline just north of the upper harbor continuous to the private residential area by the Izaak Walton property. This area includes Pottery Pond, Upper/Lower Harbor, Bay Point and Levee Park. Also, the upper marina at Colvill Park, around the park to the lower marina and back to the main channel, except in such waters and at such places as are provided therefor, and in compliance with such regulations as are herein set forth or may be hereafter adopted; or,
(b) frequent any waters or places customarily designated for the purpose of swimming or bathing, or congregate thereat when such activity is prohibited by the Director upon a finding that such use of the water would be dangerous or otherwise inadvisable.
2. Certain hours — It is a petty misdemeanor for any person in a park to: frequent any waters or places designated for the purpose of swimming or bathing, or congregate thereat, except between such hours of the day as shall be designated by the Director.
