AN ORDINANCE AMENDING CITY CODE
SECTION 5.10 BREWPUB LICENSE
THE CITY COUNCIL OF THE CITY OF RED WING ORDAINS AS FOLLOWS:
SECTION 1. Section 5.10 of Chapter 5 of the City Code of the City of Red Wing is hereby amended by deleting the overstruck language and inserting the underlined language as shown below:
SECTION. 5.10 BREWPUB LICENSE
Subd. 1. Brewpub Defined. A Brewpub is a restaurant operated on the same premises as a brewery that is licensed pursuant to this Section.
Subd. 2. State Brewpub Licenses Permitted Required. The City may issue Brewpub Licenses, A Brewpub must be licensed by the State of Minnesota
and is subject to the restrictions and regulations in this Section and Minnesota Statutes Sections 340A.24 and .301, subdivision 7 (b), or their successor.
Subd. 3. General Restrictions and Regulations for Brewpubs. Except as
otherwise provided in this Section, the restrictions and regulations for Liquor
Licenses contained in Section 5.08 of this Chapter are applicable to Brewpubs.
A.An applicant for a A Brewpub License must possess a liquor
brewer/manufacturer license issued by the State of Minnesota.
B.A Brewpub Licensee shall not have any ownership interest in any other licensed liquor or malt liquor manufacturer, brewer, importer, or wholesaler,
except for a similarly licensed restaurant-based brewpub. A Brewpub Licensee shall not be an officer, director, agent, or employee of any other licensed liquor or malt liquor manufacturer, brewer, importer, or wholesaler.
C.A Brewpub Licensee shall not manufacture more than 3,500 barrels of malt liquor in a year on the licensed premises for the purposes of consumption on the premises or for off-sale.
B.Total sale of malt liquor produced and packaged on the licensed premises shall not exceed 3,500 barrels per year, with no more than 500 750 barrels per year of malt liquor produced and packaged on the licensed premises being sold off-sale pursuant to this Section.
C.A Brewpub Licensee may only provide off-sale with a Brewpub off-sale
intoxicating license issued by the City. Brewpub off-sale shall be limited to malt liquor produced and packaged on the licensed premises in 64 ounce containers commonly known as "growlers" or in 750 milliliter bottles that are designed, sealed, and labeled pursuant to Minnesota Statutes Section 340A.285, as it may be amended from time to time.
D.Off-sale of malt liquor under this Section may be made between the hours of 8:00 a.m. and 10:00 p.m. Monday through Saturday and between the hours of 10:00 a.m. and 10:00 p.m. on Sunday. No off-sale malt liquor sales may be made on Thanksgiving Day; Christmas Day, December 25; or after 8:00 p.m. on Christmas Eve, December 24.
E.All malt liquor sold off-sale under this Section must be removed from the premises by 10:00 p.m.
SECTION 2. Effective Date. This ordinance shall be in full force and effect 14 days after its adoption and publication in accordance with the City Charter.
