SUMMONS IN APPLICATION FOR REGISTRATION OF LAND

In the Matter of the Application of Robert A. Schmaltz and Jennifer A. Beck, husband and wife, as joint tenants, to register the title to the following described real estate situated in Goodhue County, Minnesota, namely,
That part of the PUBLIC BOTTOM, that part of the PUBLIC RIGHT OF WAY, that part of PLEASANT AVENUE, and that part of the area indicated as SAND BEACH, all in WACOUTA BEACH, according to the plat thereof filed in the Goodhue County Recorder's Office, and that part of Government Lot 2, Section 32, Township 113 North, Range 13 West, Goodhue County, Minnesota, described as follows:
Commencing at a found iron pipe at the southeast corner of Lot 1, Block 5 of said WACOUTA BEACH thence on an assumed bearing of North, along the east line of said Lot 1, a distance of 100.00 feet; thence North 54 degrees 35 minutes 48 second West, a distance of 165.75 feet to the westerly line of Lot A of said Block 5; thence South 23 degrees 32 minutes 52 seconds West, a distance of 100.00 feet; thence South 21 degrees 27 minutes 08 seconds East, a distance of 14.14 feet; thence South 23 degrees 32 minutes 52 seconds West, a distance of 73.19 feet; thence North 12 degrees 20 minutes 56 seconds East, a distance of 315.82 feet, more or less, to the intersection with a straight line, hereinafter referred to as Line A, between a Judicial Land Mark at the northeasterly corner of the former Eugene J. Laqua property, as described in Goodhue County Certificate of Title Number 3167 and the northwesterly corner of Lot A, Block 5 of said WACOUTA BEACH, being the point of beginning of the land to be described; thence North 69 degrees 43 minutes 00 seconds West, along said Line A, a distance of 29.52 feet, more or less, to said Judicial Land Mark at the northeasterly corner of the former Eugene J. Laqua property; thence South 87 degrees 20 minutes 00 seconds West, along the northerly line of said former Laqua property, currently owned by Jennifer A. Beck and described in Torrens Document No. 20306, a distance of 77.10 feet to Point C as referenced in said Document Number 20306, also being the most easterly corner of Lot 1, Block 1, of LAKE PEPIN SUBDIVISION, according to the plat thereof filed in the Goodhue County Registrar of Titles Office; thence North 0 degrees 07 minutes 53 seconds East, to the shoreline of Lake Pepin; thence easterly, along said shoreline, a distance of 105 feet, more or less, to the intersection with a line bearing North from the point of beginning; thence on a bearing of South, a distance of 167 feet, more or less, to the point of beginning.

State of Minnesota; Edward H. Lidberg; Anna C. Lidberg; Janette M. Musty; also all heirs and devisees of any of the above-named persons who are deceased; and all other persons or parties unknown, claiming any right, title, estate, lien or interest in the real estate described in the Application or amendments herein,
THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:
You are hereby summoned and required to answer the Application of the Applicants in the above-entitled proceeding and to file your answer to the said Application in the office of the court administrator of said court, in said county, within 20 days after service of this Summons upon you exclusive of the day of service, and, if you fail to answer the Application within the time aforesaid, the Applicants in this proceeding will apply to the court for the relief demanded therein.
