RESOLUTION NO. 7377
A Resolution Approving a Summary of
Ordinance No. 130, Fourth Series, for Publication

BE IT RESOLVED by the City Council for the City of Red Wing as follows:
1. The City Council hereby approves the following summary of Ordinance No. 130, Fourth Series, An Ordinance Amending Chapter 2 and Chapter 4 of the Red Wing City Charter:
The above referenced Ordinance No. 130, Fourth Series, was adopted by the City Council on March 11, 2019, and will go into effect 90 days after publication of the summary of Ordinance No. 130, Fourth Series. The primary purpose of this ordinance is to amend the City Charter to reflect current laws with regard to special elections.
The following is a summary of notable changes made to Chapters 2 and 4 of the Red Wing City Charter:
2.06 - Vacancies: This section governs the events that will constitute vacancies in the Council or office of Mayor and was amended to state that a special election for filling the vacancy will be held on a date authorized by Minnesota Statutes section 205.10, subdivision 3a. The City has determined that the special election will be held on the first possible date authorized by said statute where the City can also follow the affidavit of candidacy filing period and notice of filing period requirements in Minnesota Statutes section 205.13, as amended. The City's
revisions also clarify that the vacant seat shall remain vacant until the replacement elected at the special election qualifies and takes office, and the replacement elected at the special election shall fill the unexpired part of the term of the
person requiring replacement.
If, however, a vacancy occurs in a general election year on or after April 1 and the term of the vacant seat is scheduled to expire the following year (in January), the revisions provide that no special election shall be held, and the vacant seat shall remain vacant until the replacement elected at the general election qualifies and takes office.
4.05 - Special Elections: This section governs Special Elections and has been amended to provide that a special election must be held on a date authorized
by Minnesota Statutes Section 205.10, subdivision 3a.
2.The Council further determines that publication of a summary of Ordinance No. 130, Fourth Series, would clearly inform the public of the intent and
effect of the Ordinance.
3.Accordingly, the Council hereby resolves and directs that:
a. Only this summary of Ordinance No. 130, Fourth Series, shall be published along with notice that a printed copy of the Ordinance is available for inspection by any person; and
b. A full and complete copy of the entire text of the Ordinance is available for inspection at the City Clerk's office at City Hall, 315 West 4th Street in Red Wing. A full and complete copy of the entire text of the Ordinance shall be posted in the community library between March 16, 2019, and March 25, 2019.
