Criminal sexual charge involves 15-year-old

A Red Wing man was charged with three counts of criminal sexual conduct, use of minors in sexual performance and possession of pornograpic work, according to a criminal complaint filed in Goodhue County District Court last week.

Terence Dwayne McDonald, 21, 1333 Central Park St., allegedly had sex with a 15-year-old female multiple times over the last few months.

Police were called to a Red Wing residence to remove an unwanted person, according to the complaint, and after speaking with the homeowner, who was out of town, and getting the code to open the garage door, police entered the home and found the 15-year-old in the house with McDonald.

The house was the juvenile’s parents’ home, the complaint states.

The juvenile said she met McDonald approximately six weeks prior and initially told police she hadn’t had any sexual contact with McDonald, the complaint states.

McDonald, on the other hand, who was taken outside for questioning, told police he did have sex with the juvenile, whom he said he believed to be 16 years old at the time, authorities said.

During a second recorded interview, the juvenile admitted she did have a physical relationship with McDonald.

“I’m not going to lie, I do want a relationship with him and it’s hard for him because I do know his age and I have a couple months until I’m 16 and it will be legal,” she said in the complaint.

At the Law Enforcement Center, Red Wing police questioned McDonald again.

McDonald told police, according to the complaint, that when he first met the juvenile, she told him she was 18 years old and “the last couple times … she was 17.”

McDonald gave police permission to search his phone, authorities said, and told them there was a six-second video on his phone of him having sex with the juvenile.

“It’s gonna be on there,” he allegedly told police. “But I didn’t know she was 15.”

Investigators discovered the defendant’s cellphone “did contain several short videos” as well as a longer video, the complaint states.

In the longer video, which was recorded May 29, police identified the male and female in the video to be McDonald and the juvenile, according to the complaint, with McDonald 20 years old and the juvenile 15 years old at the time.

Third-degree criminal sexual conduct is punishable by up to 15 years in prison and a $30,000 fine, use of minors in sexual performance and fourth-degree criminal sexual conduct both carry a maximum sentence of 10 years in prison and a $20,000 fine and fifth-degree criminal sexual conduct is punishable by up to one year in jail and a $3,000 fine.

Possess pornographic work is punishable by up to five years in prison and a $5,000 fine.

McDonald is scheduled to make his next court appearance July 8.
