RESOLUTION AUTHORIZING PUBLICATION OF

ORDINANCE NO. 2013-01 BY TITLE AND SUMMARY

WHEREAS, the Town Board of Hay Creek Township (the "Town") adopted Ordinance No. 2013-01, the HAY CREEK TOWNSHIP ZONING ORDINANCE ("Ordinance");

WHEREAS, Minnesota Statutes, section 365.125, subdivision 3 allows publication by title and summary of ordinances adopted by the Town Board; and

WHEREAS, the Town Board determines it is impractical to publish the entire Ordinance and that the following summary clearly informs the public of the intent and effect of the Ordinance and indicates where the entire Ordinance may be obtained.

NOW, THEREFORE, BE IT RESOLVED, the Town Board of Hay Creek Township hereby determines to publish the following summary language, which is hereby approved, in lieu of publishing the entire Ordinance:

HAY CREEK TOWNSHIP ZONING ORDINANCE

The Town Board of Hay Creek Township adopted Ordinance No. 2013-01, an ordinance adopting certain zoning regulations for the Town that apply in addition to the County's regulations. The ordinance allows noncommercial mining activities without a permit, allows commercial mining operations only in the Agricultural Protection District with the issuance of an interim use permit, and prohibits large-scale commercial mining operations and mineral processing facilities throughout the Town. The ordinance requires building permits and imposes certain other restrictions and requirements that are at least as strict as those imposed by the County. The ordinance is in effect as of this publication. The full text of the ordinance is posted on the Town's website, at the Red Wing Public Library, and is available by contacting the Town Clerk.
