SUMMONS IN APPLICATION FOR REGISTRATION OF LAND

In the Matter of the Application of Donald E. Falk and Nancy J. Falk, husband and wife, as joint tenants, to register the title to the following described real estate situated in Goodhue County, Minnesota, namely,

Lots A and 1 in Block 5 of WACOUTA BEACH according to the plat thereof on file and of record in the office of the County Recorder for Goodhue County, State of Minnesota.

AND

That part of the PUBLIC BOTTOM, and that part of the PUBLIC RIGHT OF WAY, and that part of LAKEVIEW AVENUE, all in the plat of WACOUTA BEACH, according to the recorded plat thereof, described as follows:

Commencing at a found iron pipe at the southeast corner of Lot 1, Block 5, of said WACOUTA BEACH; thence on an assumed bearing of North, along the east line of said Lot 1, a distance of 100.00 feet; thence North 54 degrees 35 minutes 48 seconds West, a distance of 165.75 feet to the westerly line of Lot A, of said Block 5 being the point of beginning of the land to be described; thence South 23 degrees 32 minutes 52 seconds West, a distance of 100.00 feet; thence South 21 degrees 27 minutes 08 seconds East, a distance of 14.14 feet; thence South 23 degrees 32 minutes 52 seconds West, a distance of 73.19 feet; thence South 85 degrees 16 minutes 41 seconds East, a distance of 133.95 feet to the southwesterly line of said Lot A; thence northwesterly and northerly along said southwesterly and westerly line to the point of beginning.

AND

That part of the PUBLIC BOTTOM, that part of the PUBLIC RIGHT OF WAY, and that part of LAKEVIEW AVENUE, all in WACOUTA BEACH, according to the plat thereof filed in the Goodhue County Recorder’s Office, described as follows:

Commencing at a found iron pipe at the southeast corner of Lot 1, Block 5 of said WACOUTA BEACH; thence on an assumed bearing of north, along the east line of said Lot 1, a distance of 100.00 feet; thence North 54 degrees 35 minutes 48 seconds West, a distance of 165.75 feet to the westerly line of Lot A of said Block 5, being the point of beginning of the land to be described; thence South 23 degrees 32 minutes 52 seconds West, a distance of 100.00 feet; thence South 21 degrees 27 minutes 08 seconds East, a distance of 14.14 feet; thence South 23 degrees 32 minutes 52 seconds West, a distance of 73.19 feet; thence North 12 degrees 20 minutes 56 seconds East, a distance of 315.82 feet, more or less, to the intersection with a straight line between a Judicial Land Mark at the northeasterly corner of the former Eugene J. Laqua property, as described in Goodhue County Certificate of Title Number 3167 and the northwesterly corner of Lot A, Block 5 of said WACOUTA BEACH; thence easterly, a distance of 13.67 feet, more or less, to said northwesterly corner of Lot A; thence southerly, along the westerly line of Lot A, to the point of beginning.

AND

That part of the PUBLIC BOTTOM, that part of the PUBLIC RIGHT OF WAY, that part of PLEASANT AVENUE, and that part of the area indicated as SAND BEACH, all in WACOUTA BEACH, according to the plat thereof filed in the Goodhue County Recorder’s Office, and that part of Government Lot 2, Section 32, Township 113 North, Range 13 West, Goodhue County, Minnesota, described as follows:

Commencing at a found iron pipe at the southeast corner of Lot 1, Block 5 of said WACOUTA BEACH; thence on an assumed bearing of North, along the east line of said Lot 1, a distance of 100.00 feet; thence North 54 degrees 35 minutes 48 seconds West, a distance of 165.75 feet to the westerly line of Lot A of said Block 5; thence South 23 degrees 32 minutes 52 seconds West, a distance of 100.00 feet; thence South 21 degrees 27 minutes 08 seconds East, a distance of 14.14 feet; thence South 23 degrees 32 minutes 52 seconds West, a distance of 73.19 feet; thence North 12 degrees 20 minutes 56 seconds East, a distance of 315.82 feet, more or less, to the intersection with a straight line, hereinafter referred to as Line A, between a Judicial Land Mark at the northeasterly corner of the former Eugene J. Laqua property, as described in Goodhue County Certificate of Title Number 3167 and the northwesterly corner of Lot A, Block 5 of said WACOUTA BEACH, being the point of beginning of the land to be described; thence North, parallel with the east line of said Lot 1, a distance of 167 feet, more or less, to the shoreline of Lake Pepin; thence easterly, along said shoreline, a distance of 135 feet, more or less, to the intersection with the northerly extension of the east line of said Lot 1; thence South, along the northerly extension of the east line of said Lot 1, a distance of 195 feet, more or less, to the northeast corner of said Lot 1; thence westerly, along the north line of said Lot 1 and along the north line of said Lot A, to the northwesterly corner of said Lot A; thence northwesterly, along said Line A, to the point of beginning.

THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:

You are hereby summoned and required to answer the Application of the Applicants in the above-entitled proceeding and to file your answer to the said Application in the office of the court administrator of said court, in said county, within 20 days after service of this Summons upon you exclusive of the day of service, and, if you fail to answer the Application within the time aforesaid, the Applicants in this proceeding will apply to the court for the relief demanded therein.
