State Supreme Court asked to consider rental code lawsuit

Tenants and landlords, along with the Institute for Justice, who are questioning Red Wing’s rental inspection code asked the Minnesota Supreme Court on Wednesday to take up their case.

Tenants and landlords, along with the Institute for Justice, who are questioning Red Wing’s rental inspection code asked the Minnesota Supreme Court on Wednesday to take up their case.

On June 11, the Minnesota Court of Appeals upheld the city’s inspection code. The challengers said then they would fight the ruling.

Last year the state’s highest court ruled that the case challenging the constitutionality of the law could continue and sent it to the appeals court.

Under the city’s code, inspectors can enter properties if landlords or tenants refuse initial inspections, provided inspectors get approval from a judge through an administrative warrant.
