MOTION

Pursuant to MINN. STAT. Ch. 565, Claimant moves the Court for an Order requiring Respondents to deliver to Claimant immediate possession of the property described in the Complaint so as to permit sale of the same according to applicable law. This motion is submitted on the Complaint and the attached exhibits, the Claimant's Affidavit, and upon all files, records, and proceedings herein.

PLEASE TAKE NOTICE that a hearing will be held at 9:30 a.m. on August 3, 2012, (check with Court Administrator for courtroom assignment) at the Goodhue County Courthouse, 454 West Sixth Street, Red Wing, MN 55066, to determine whether the Sheriff shall remove from your possession and deliver to Claimant the following property of Respondent:

You have the right to appear at this hearing on your own behalf or with an attorney. You will have the opportunity to present defenses to the Claimant's claims and to state reasons why the property described above should not be taken. If the Court determines that the Claimant has the right to have possession of the property while the lawsuit is pending, you may nevertheless keep the property until the lawsuit is decided if you file with the Court a surety bond in the amount of $14,025.00, which amount is the lesser of one and one-half times the Claimant’s claim and one and one-quarter times the Claimant’s estimate of the property value. If you believe the amount of the claim or the value of the property is overstated, you may ask the Court to reduce it.

If you do not appear at this hearing, the Court has the authority to issue an order directing that the above-described property be immediately taken from your possession.
