Appeals court rules for city in rental code lawsuit

The Minnesota Court of Appeals ruled Monday that those challenging Red Wing’s rental code have not proven it is unconstitutional.

The code has been challenged in court because of inspection provisions that allow the city to seek administrative warrants from a judge if landlords and tenants refuse initial property inspections.

The Minnesota Supreme Court ruled in December that the case could continue and should be heard by the appeals court. The Court of Appeals upheld earlier rulings from other courts.

The Institute for Justice, representing the renters and landlords that filed the lawsuit, said they would appeal the ruling. That would send the case back to the state supreme court.
