TO
TAKE LAND “IN TRUST”
ACTION: Notice of final agency determination to take land into trust under 25 Code of Federal Regulations, Part 151.
SUMMARY: The Regional Director, Midwest Regional Office, Bureau of Indian Affairs, U.S. Department of the Interior on the below date, has made a final determination to acquire real property “in trust” for the Prairie Island Indian Community of Minnesota.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 C.F.R., Part 151.12(b) that notice be given to the public of the decision by the authorized representative of the Secretary of the Interior to acquire land “in trust” at least 30 days prior to signatory acceptance of land “in trust.” The purpose of the 30-day waiting period is to afford interested parties the opportunity to seek judicial review of administrative decisions to take land “in trust” for Tribes or individual Indians before transfer of title to the properties occurs. On April 3, 2012, the Regional Director issued a Decision Notice to accept land “in trust” for the Prairie Island Indian Community of Minnesota under the authority of Section 201 of Public Law No. 109-221, 120 Stat. 336 (May 12, 2006).
The Regional Director, on behalf of the Secretary of the Interior, shall acquire title in the name of the United States of America in trust for the Prairie Island Indian Community of Minnesota no sooner than 30 days after the initial date this notice is published in a newspaper.
The property to be acquired is located in Township 114 North, Range 15 West, Fifth Principal Meridian, in Goodhue County, Minnesota, and is described in Public Law 106-221 as approximately 1290 acres of land associated with the Lock and Dam #3 on the Mississippi River in Goodhue County, Minnesota, located in tracts identified as GO-251, GO-252, GO-271, GO-277, GO-278, GO-284, GO-301 through GO-313, GO-314A, GO-314B, GO-329, GO-330A, GO-330B, GO-331A, GO-331B, GO-331C, GO-332, GO-333, GO-334, GO-335A, GO-335B, GO-336 through GO-338, GO-339A, GO-339B, GO-339C, GO-339D, GO-339E, GO-340A, GO-340B, GO-358, GO-359A, GO-359B, GO-359C, GO-359D, and GO-360, as depicted on the map entitled “United States Army Corps of Engineers survey map of the Upper Mississippi River 9-Foot Project, Lock & Dam No. 3 (Red Wing), Land & Flowage Rights” and dated December 1936.
