ORDER TO SHOW CAUSE

For an Order for Issuance of a New Certificate of Title

TO:The heirs of Norman T. Magnussen, Grace B. Magnussen, Will B. Erickson, Anna R. Erickson, and Anna F. Erickson; Weis Builders, Inc.; State of Minnesota; The First State Bank of Red Wing; and all other persons or parties unknown claiming any right, title, estate, lien or interest in the real estate described in the Order to Show Cause herein.

Upon receiving and filing the Petition and the Report of the Examiner of Titles in the above-entitled matter pursuant to Minn. Stat. § 508.71,

IT IS HEREBY ORDERED that all persons interested appear before this Court on the 18th day of May, 2012, at 8:45 a.m., at the Goodhue County Justice Center, and then, or as soon thereafter as the matter can be heard, show cause, if there is any, why this Court should not enter an Order as follows:

1. Determining that the City of Red Wing is the fee owner of the real property included in a larger tract originally registered by Norman T. Magnussen and Grace B. Magnussen and Will B. Erickson and Anna R. Erickson or Anna F. Erickson, and acquired by the State of Minnesota in 1953 through eminent domain proceedings by a Final Certificate, Document No. 1494, and subsequently conveyed to the City of Red Wing by Quit Claim Deed, Document No. 303658, said property described as follows:

Parcel 3, City of Red Wing Right of Way Plat No. 5.

2. Directing the Goodhue County Registrar of Titles to issue a new Certificate of Title for the property described above in the name of the City of Red Wing, as fee simple owner.

3. Directing the Goodhue County Registrar to Titles to memorialize upon the new Certificate of Title the Order of the Court in this matter, but omit said Order as a memorial upon succeeding certificates of title to the land described as Parcel 3, City of Red Wing Right of Way Plat No. 5.

IT IS FURTHER ORDERED that this Order to Show Cause be served upon the respondents as set out in the Minnesota Rules of Civil Procedure.

ATTENDANCE IS NOT REQUIRED AT SAID TIME EXCEPT TO

OBJECT TO THE ENTRY OF THE ABOVE-DESCRIBED ORDER
