That part of the following described property lying North of a line parallel and 600 feet southerly, measured at right angles to the southerly right of way line of East Seventh Street.
Beginning at a point 13.62 chains (898.9 feet) East from the Southwest (SW) corner of Section 28, Township 113 North, Range 14 West, of the Fifth Principal Meridian, running thence North ten degrees fifteen minutes East (N 10 degrees 15’ E) 20.25 chains (1336.5 ft.) to the North line of the South one-half (S-1/ 2) of the Southwest Quarter (SW1/4) of said Section 28, thence West to a point 9.60 chains (633.6 ft.) East from the Northwest (NW) corner of the South one-half (S-1/2) of the Southwest Quarter (SW- 1/4) of said Section; thence North ten degrees fifteen minutes East (N 10 degrees 15’E) 13.80 chains (910.8 ft.); thence North fifty-seven degrees West (N 57 degrees W) 2.75 chains (181.5 ft.) to a point 6.65 chains (438.9 ft.) South ten degrees fifteen minutes West (S 10 degrees 15’ W) from the Southerly line of East Seventh Street; thence South ten degrees fifteen minutes West (S 10 degrees 15’ W) to the South line of said Section 28; thence East to place of beginning.

That part of the following described property lying North of a line parallel with and 600 feet southerly of, measured at right angles to, the southerly right of way line of East Seventh Street.
Beginning at a point 12.96 chains (855.3 ft.) East of the Northwest (NW) corner of the South one-half (S 1/2) of the Southwest Quarter (SW 1/4) of Section 28, Township 113 North, Range 14 West of the Fifth Principal Meridian; running thence North 23 degrees East (N 23 Degrees E) 8.20 chains (541.2 ft.); thence North 21-1/2 degrees West (N 21- 1/2 degrees W) 3.87 chains (255.4 ft.); thence North 10 degrees East (N 10 degrees E) 1.24 chains (81.8 ft.); thence North 57 degrees West (N 57 degrees W) 55 links (36.3 ft.); thence North 35 degrees 57 minutes West (N 35 degrees 57’ W) 163.8 feet; thence North 57 degrees West (N 57 degrees W) 65 feet; thence North 10 degrees 15 minutes East (N 10 degrees 15’ E) 378 feet to the Southerly line of E 7th Street; thence N 76 degrees W along the Southerly line of E. 7th Street 156 ft. to the Easterly line of Wilkinson’s Addition to Red Wing; thence S 10 degrees 15 minutes West along the Easterly line of Wilkinson’s addition 432.3 ft.; thence S. 57 degrees E 2.75 chains (181.5 ft.); thence S. 10 degrees 15’W. 13.80 chains (910.8 ft.) to the N line of the S-1/2 of the SW-l/4 of said Section 28; thence E 3 chains (198 ft.), more or less, to the point of beginning, containing 7.0 acres, more or less.
EXCEPT FROM THE PREVIOUS TWO DESCRIBED PARCELS, THE FOLLOWING:
That part of Government Lot 7 of Section 28, Township 113 North, Range 14 West, Goodhue County, Minnesota, described as follows:
Commencing at the intersection of the southerly right of way line of East 7th street, as now located and established with the easterly line of Block 3 of WILKINSON’S ADDITION, according to the recorded plat thereof on file in the office of the Goodhue County Recorder; thence southeasterly, along said southerly right of way line of East 7th Street a distance of 146.70 feet to the point of beginning of the land to be described; thence southerly, deflected to the right 79 degrees 36 minutes 55 seconds, a distance of 370 feet, more or less, to the northwesterly extension of the southerly line of the property described in Document Number 398931, on file in the office of the Goodhue County Recorder; thence southeasterly, along said northwesterly extension to the southwesterly corner of said property described in Document Number 398931; thence northerly, along the westerly line of said property described in Document Number 398931 to the southerly right of way line of said East 7th Street; thence northwesterly, along said southerly right of way line of East 7th Street to the point of beginning.
TO: Gregory A Reichstadt, Carolyn E. Reichstadt, White Rock State Bank and Empire Funding Corporation.
Upon receiving and filing the Report of the Examiner of Titles in the above entitled matter:
IT IS ORDERED, that you, and all persons interested, appear before this Court on the 20th day of January, 2012, at 8:45 a.m., at the Goodhue County Justice Center, 454 West Sixth Street, Red Wing, County of Goodhue, State of Minnesota, and then, or as soon thereafter as said matter can be heard, show cause, if any there be, why this Court should not enter an Order as follows:
That the Registrar of Titles of Goodhue County, upon the filing of a certified copy of this Order, cancel Certificate of title No. 4544 and enter a new certificate of title for the land therein described in favor of Anthony Berghammer and Samantha Berghammer, husband and wife, 761 E. 7th Street, Red Wing, MN 55066, free from all memorials now appearing on the present Certificate of Title, the last of which is Document No. T23699, and free also from the memorial of this Order.
IT IS FURTHER ORDERED, That this Order be served: (a) at least 10 days before the hearing upon the above-named parties residing in this State in the manner provided by law for the service of Summons in a civil action; (b) at least 14 days before the hearing upon each of the above-named non-residents by sending a copy of this Order to the non-resident's post office address, by registered or certified mail, return receipt requested; (c) upon each of the above-named parties who cannot be found by two weeks published notice and by sending a copy of this Order at least 14 days before the hearing by first class mail to the last known address of the party and by sending another copy of this Order at least 14 days before the hearing by first class mail to the address of such party as stated on the Certificate of Title if an address is so stated, (d) upon a dissolved, withdrawn, or revoked business entity governed by Minn. Stat. Chp. 302A, 303, 317A, 322A, 322B, or 323 in the manner provided by Minn. Stat. § 5.25.
