RESOLUTION NO. 6315

A Resolution Approving Publication of the Summary of

Ordinance No. 13, Fourth Series

The City Council hereby approves the following summary of Ordinance No. 13, Fourth Series, an Ordinance renewing a cable television franchise to Marcus Cable Partners, L.P. d/b/a Charter Communications (“Charter”) to construct, operate and maintain a cable television system in the City of Red Wing.

The Ordinance includes the following:

1)a ten (10) year franchise term;

2)requires Charter to provide three (3) channels available for local public, educational and governmental programming;

3)requires Charter to provide capital funding for local public, educational and governmental programming in the initial amount of $.50 per subscriber, per month;

4)requires Charter to provide a subscriber network drop and monthly cable service, free of charge, to specified public and educational institutions;

5)requires Charter to comply with strong customer service obligations consistent with FCC standards;

6)imposes a franchise fee of five percent (5%) of Charter’s annual gross revenues;

7)requires Charter to maintain a letter of credit for the entire term of the franchise in the amount of $10,000; and

8)requires Charter to provide connections from specified locations in the City to facilitate live cablecasting of local programming.

The City Council determines that the publication of the title and summary of the Ordinance would clearly inform the public of the intent and effect of the Ordinance.

Accordingly, the City Council hereby resolves and directs that:

1)Only the title of the Ordinance and this summary be published;

2)A printed copy of the entire text of the Ordinance be made available for inspection by any person; and

3)A copy of the entire text of the Ordinance be posted in the Red Wing Public Library between October 1, 2011 and March 31, 2012, and made available for review at the City Administrator’s office located at 315 West 4th Street, Red Wing, Minnesota 55066.
