Predatory offender has served his sentence

A level three predatory offender who moved to Red Wing Monday has completely finished his sentence and is no longer under the authority of the Minnesota Department of Corrections, DOC spokeswomen Sarah Berg said.

Joseph Upsher, 58, was released from Minnesota Correctional Facility-Rush City earlier this week after serving a 21-month sentence for felony domestic assault.

"He is not under the supervision of an agent in the community," Berg said. "However, he is still required to register as a predatory offender and notify law enforcement of his whereabouts."

Because Upsher will be homeless in Red Wing, he won't be able to register an actual address with law enforcement. Therefore, he must check in at least weekly and give the Red Wing Police Department "as much specificity as possible about where they will be staying," Berg said.

Under Minnesota statute, offenders serve two-thirds of their sentences behind bars and the last one-third in the community under intensive supervised release.

Last February, Upsher was released from prison to serve his time on supervised release. But because he failed to maintain contact with his agent, Upsher was arrested and sent back to prison last June to serve his full sentence behind bars.

The last predatory offender to move to Red Wing, Andre Demond Tolefree, was serving the last one-third of his sentence, and was therefore on intensive supervised release. That included GPS monitoring and frequent check-ins with DOC agents.

Upsher has finished his sentence and won't have GPS monitoring. He no longer needs to be supervised by the DOC, Berg said.

A fact sheet from the Red Wing Police Department says Upsher has a history of sexual contact, including penetration, with adult females and holding victims against their will.

Berg added that Upsher has also spent time in prison for several felony offenses, including first-degree burglary, kidnapping and failure to register as a predatory offender.

Upsher is described as 5 feet, 9 inches tall, 175 pounds with a medium brown complexion, brown eyes and black hair.

The Red Wing Police Department stressed that Upsher is not wanted by the police. However, anyone seeing Upsher commit criminal activity should call 911.
