Ordinance No. 56, Fourth Series
AN ORDINANCE AMENDING CHAPTER 10 OF THE RED WING CITY CODE
THE CITY COUNCIL OF THE CITY OF RED WING DOES ORDAIN:
SECTION 1. Chapter 10 of the City Code is hereby amended by deleting the overstruck language and inserting the underlined language as shown below:
SECTION 10.19.MINNESOTA STATE FIRE CODE.

Subd. 2.Fire Suppression Systems.
A.The limits set forth at Section 105.7.1 of the Minnesota State Fire Code in which construction permits are required for the installation or modification of fire sprinkler systems are hereby adopted as the limits for the city.
1.The party wanting such installation permit shall make application to Community Development the receptionist at City Hall for an installation permit on a form provided by the Fire Department, at least thirty (30) days prior to the date on which the installation or modification shall begin. At this time plans conforming to NFPA 13 (or other applicable standards) shall be submitted in duplicate that include all drawings, calculations, and spec sheets.
Subd. 3. Fire Detection / Alarm Systems.
A.The limits set forth at Section 105.7.4 of the Minnesota State Fire Code in which construction permits are required for the installation or modification of fire detection / alarm systems are hereby adopted as the limits for the city.
1. The party wanting such installation permit shall make application to Community Development the receptionist at City Hall for an installation permit on a form provided by the Fire Department, at least 30 days prior to the date on which the installation or modification shall begin. At this time plans conforming to NFPA 72 shall be submitted in duplicate that include all drawings, calculations and spec sheets.
Subd. 4. Open Burning:
A.The limits set forth at Section 105.6.30 of the Minnesota State Fire Code in which operational permits are required for open burning are hereby adopted as the limits for the city.
1.The party wanting such permit shall make application to Community Development the receptionist at City Hall for a permit on a form provided by the Fire Department, at least three days prior to the date on which burning shall commence. Open burning is prohibited when burning restrictions or bans are in place.

Subd. 6. Outdoor Fireworks Displays.
A. The limits set forth at Section 105.6.14 of the Minnesota State Fire Code in which operational permits are required for the public display of fireworks are hereby adopted as the limits for the city.
1.The party wanting such permit shall make application to the City Hall Receptionist for an operational permit on a form provided by the Fire Department, at least 15 days prior to the date on which the display shall take place. At this time, the permit application and all required attachments shall be submitted in duplicate to demonstrate compliance with the ordinances and codes of the City of Red Wing, the Minnesota Fire Code, MN Statute 624.20 through 624.25, National Fire Protection Association Standard 1123, and applicable federal laws. The permit fee must be submitted with the application.
2.Pursuant to Minnesota Statutes section 624.22, the City’s fire chief or designee will determine whether the fireworks display operator is certified, whether the operator is competent, and whether the fireworks display conforms to the safety guidelines issued by the state fire marshal. If the Fire Chief or designee determines that the above criteria are met, the City Clerk shall issue a permit for the fireworks.
Subd. 6 7. Penalties. In addition to the penalties set forth at Section 10.28 of this Code, the following shall also apply.
A.Civil: If a violation is suspected, the Fire Chief, Fire Marshal, any firefighter, DNR employee, or other peace officer may enter the property on which the suspected violation has occurred. A violator shall be informed of such violation and be given a time from the date of such notice to correct or remedy such violation to the satisfaction of the Fire Department. In the event the violation is not corrected or remedied within such time period, The Fire Chief, Fire Marshal, any firefighter, DNR employee, or other peace officer may correct or remedy a violation in such manner as the Fire Department, in its sole discretion, shall determine and shall charge the cost and expense, if any, for doing so back to the property owner.
B.Criminal. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue. When not otherwise specified, each five days that the prohibited conditions remain shall constitute a new and separate offense. The application of any criminal penalties shall not be held to prevent the correction or remedy of the violation by the Fire Department.
Subd. 7 8. Nuisance. For purposes of this Section, the tem “nuisance” refers to anything that affects the general public and is injurious to health, or indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property.
SECTION 2. Effective Date. This Ordinance is effective 14 days following the publication of the ordinance in accordance with the City Charter.
