AN ORDINANCE AMENDING CHAPTER TWO OF THE CITY CODE BY AMENDING SECTIONS 2.08, 2.11, 2.12, AND 2.13 WHICH CONCERN BOARDS AND COMMISSIONS
THE CITY COUNCIL OF THE CITY OF RED WING ORDAINS AS FOLLOWS:
SECTION 1. Certain sections of Chapter 2 of the City Code of the City of Red Wing are hereby amended by deleting the overstruck language and inserting the underlined language as shown below:
SEC. 2.08. BOARDS AND COMMISSIONS GENERALLY.
Subd. 4. Residency.
Except as otherwise provided in this Chapter, all All appointees shall have been residents of the City for at least six months. If questions arise concerning the continued residency of a Board or Commission member, the Council shall appoint a subcommittee of the Council to gather facts pertinent to the residency question. The subcommittee shall make a recommendation to the Council as to its findings. In assessing residency, the Council shall consider whether the individual at issue votes or is eligible to vote in the City, whether the individual lives within the City limits, and the address listed on the individual’s drivers license as predominant factors of residency, though the Council is free to consider other evidence it determines is relevant to the residency question.
SECTION 2.11. HUMAN RIGHTS COMMISSION.
Subd. 2. Composition.
The Commission shall be composed of seven members. Members shall be residents of the City in accordance with Section 2.08, Subdivision 4, of this Chapter, or nonresidents of the City drawn from within the boundary limits of Independent School District No. 256. Such nonresidents shall have resided within the boundary limits of the School District for at least six months. The number of nonresident members must not constitute a quorum or more of the Commission. The Commission is not required to contain a minimum number of nonresidents as members. All members shall have the right to vote.
SECTION 2.12. SISTER CITIES COMMISSION.
Subd. 2. Composition.
The Sister Cities Commission shall consist of up to 15 members, two of which may be an advisory member. Members shall be residents of the City in accordance with Section 2.08, Subdivision 4, of this Chapter, or nonresidents of the City drawn from within the boundary limits of Independent School District No. 256. Such nonresidents shall have resided within the boundary limits of the School District for at least six months. The number of nonresident members must not constitute a quorum or more of the Commission. The Commission is not required to contain a minimum number of nonresidents as members. All members shall have the right to vote. A resident of the Red Wing School District 256 who resides outside of the Red Wing City limits may be appointed as advisory members, as defined in Section 2.04 of the City Charter.
SECTION 2.13. SUSTAINABILITY COMMISSION.
Subd. 2. Composition.
The Commission shall be composed of a minimum of nine members and a maximum of fifteen voting and advisory members. Members must be residents of the City in accordance with Section 2.08, Subdivision 4, of this Chapter, or nonresidents of the City drawn from within the boundary limits of Independent School District No. 256. Such nonresidents shall have resided within the boundary limits of the School District for at least six months. The number of nonresident members must not constitute a quorum or more of the Commission. The Commission is not required to contain a minimum number of nonresidents as members. All members shall have the right to vote. Up to two residents of Goodhue County but not of the City of Red Wing may be appointed as advisory members, as defined in Section 2.04 of the City Charter.
SECTION 2: Effective Date. This ordinance shall be in full force and effect after its adoption and publication in accordance with the City Charter.
