A former Red Wing McDonald’s manager was found guilty of two felony counts of fourth-degree criminal sexual conduct. The ruling came Friday morning in Goodhue County District Court.


Kimberly Noel Voelker, 44, Hastings, was sentenced to 180 days in prison, 10 years supervised probation, and fined $560 after a court complaint filed Jan. 7, 2013, stated she inappropriately touched two juveniles while they were working.

Voelker also was ordered to complete outpatient sex offender treatment programming, register as a predatory offender and have no contact with the victims or any minor males.

Voelker touched the boys’ groin areas and buttocks through their clothing while she was working as their shift manager, according to the complaint.

One boy reported that Voelker touched his genitals two times in August 2012. He added she also pinched his butt and nipples over the clothing on other occasions, the complaint says.

The second boy told police that Voelker reached around his waist and grabbed his groin while he was working at the grill station. She also made several sexual comments and gestures to the boys, according to the complaint.

“I accept what I did was wrong,” Voelker said before the judge read her sentence. “I’m sorry.”

Voelker received a stay of imposition for both counts of fourth-degree criminal sexual conduct. One gross misdemeanor count of fifth-degree criminal sexual conduct was dismissed.

Voelker is allowed contact with her 17-year-old son, but cannot have unsupervised contact with her grandchildren. She is to remain law-abiding, have no possession or use of drugs or alcohol, submit to random testing, no possession or use of firearms, take medication in the prescribed dosage and frequency, attend Gamblers Anonymous and supply a DNA sample.

The maximum sentence possible for each count of fourth-degree criminal sexual conduct charges was 10 years in prison and a $20,000 fine.

Her jail term will begin Jan. 24.
