ADVERTISEMENT FOR BIDS
Notice is hereby given that sealed bids will be received at the office of the City Clerk, City Hall, Red Wing, Minnesota until 2:00 p.m. on Thursday the 8th day of March, 2018, at which time they will be publicly opened and read. After tabulation, the bids and the responsibility of the bidders will be considered by the City Council at 7:00 PM on March 12, 2018 in the council chambers of the City Hall for the Furnishing of all labor, tools, materials, equipment and all else necessary for the construction of sanitary sewer, watermain, storm sewer, aggregate base, concrete curb & gutter, concrete sidewalk, bituminous pavement, electrical lighting system, signal system and other appurtenant construction on Spring Creek Road and T.H. 61 located in the City of Red Wing, Minnesota, consisting of the following approximate quantities:

All in accordance with specifications on file at the City Engineering Department, 229 Tyler Road North, Red Wing, MN 55066. Plans, Specifications, bid forms, and general instructions for bidders may be examined at the Office of the City Engineer. Complete sets of Plans and Proposals (bidding documents) will be available for downloading on February 14, 2018 from the City of Red Wing website at http://www.red-wing.org and by clicking on the Quick Links then Project & Equipment Bids for QuestCDN Project #5545861. There is a nonrefundable fee of $20.00 for the electronic Plans and Bidding Documents. All bidders must be a registered plan holder with QuestCDN to be a qualified bidder with the City of Red Wing.
Bids must be on the basis of cash payment for the work and material, and no bid will be considered unless sealed and filed with the City Clerk at City Hall, 315 West Fourth Street, Red Wing, MN, and accompanied by a cash deposit, certified check or bidder's bond payable to the City of Red Wing, for not less than five (5) percent of the bid, as a guarantee that the bidder will, if awarded the contract, enter promptly into an agreement with the City and furnish a performance bond for the full amount of the contract and a payment bond for the full amount of the contract as provided by law. The deposit will be subject to forfeiture as provided by law.
Cash deposits, certified checks and bidder's bonds of the three lowest bidders may be retained until the contract has been awarded and executed, but no longer than thirty (30) days from the date of opening bids. All other deposits will be returned promptly.
Minimum wage rates to be paid by the Contractors have been predetermined and are subject to the Work Hours Act of 1962, P.L. 87-581 and implementing regulations.

The Minnesota Department of Transportation hereby notifies all bidders:
in accordance with Title VI of the Civil Rights Act of 1964 (Act), as amended and Title 49, Code of Federal Regulations, Subtitle A Part 21, Non-discrimination in Federally-assisted programs of the Department of Transportation, it will affirmatively assure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded maximum opportunity to participate and/or to submit bids in response to this invitation, and will not be discriminated against on the grounds of race, color, disability, age, religion, sex or national origin in consideration for an award;

The following notice from the Minnesota Department of Human Rights applies to all contractors:
"It is hereby agreed between the parties that Minnesota Statute, section 363A.36 and Minnesota Rules, parts 5000.3400 to 5000.3600 are incorporated into any contract between these parties based on this specification or any modification of it. A copy of Minnesota Statute 363A.36 and Minnesota Rules, parts 5000.3400 to 5000.3600 is available upon request from the contracting agency."
"It is hereby agreed between the parties that this agency will require affirmative action requirements be met by contractors in relation to Minnesota Statute 363A.36 and Minnesota Rules 5000.3600. Failure by a contractor to implement an affirmative action plan or make a good faith effort shall result in revocation of its certificate or revocation of the contract (Minnesota Statute 363A.36, Subd. 2 and 3)."
A minimum goal of 12.0 % Good Faith Effort to be subcontracted to Disadvantaged Business Enterprises.
The City reserves the right to reject any and all bids and to waive any informality therein and to adjourn the meeting to a later date for the purpose of further consideration of the bids and taking action thereon. No bid may be withdrawn within thirty (30) days from the date of opening of bids.
